1. Eligibility & authority
You must be at least the age of digital consent in your territory (often 16-18) or have verifiable parental permission. If you use BabyCam on behalf of a company, you warrant that you can bind that organisation.
You may not use the product if you are barred under applicable sanctions or export laws.
2. Peer-to-peer nature of the service
BabyCam facilitates encrypted real-time sessions between devices you authorise. Quality depends on hardware, OS permissions, battery state, Wi-Fi congestion, cellular NAT, and ISP policies.
We may change codecs, TURN providers, or fallback strategies without notice to keep calls connected.
We may schedule maintenance that briefly interrupts cloud signaling—LAN-only flows may still work.
3. Acceptable & prohibited conduct
You agree to monitor only where law and household rules allow, obtain informed consent from cohabitants when required, and avoid covert surveillance of adults or protected spaces.
You must not use BabyCam to stalk, harass, discriminate, stream sexually explicit content, violate workplace policies, or infringe intellectual property.
You must not probe, scrape, overload, or bypass security controls; interfere with other users; or mine cryptocurrency using our infrastructure.
4. Accounts, devices & credentials
Keep passwords, OTPs, and biometric locks confidential. Notify soporte@yunda.me if you suspect takeover.
You are liable for activity conducted through your account until you prove otherwise.
We may throttle or terminate sessions exhibiting automated abuse.
5. Privacy & data protection
Personal data handling is governed exclusively by the Privacy Policy and product disclosures. Store purchases produce additional records retained by Apple/Google.
6. Subscriptions, trials & billing disputes
Fees, taxes, introductory offers, renewals, cancellations, family-sharing rules, and refunds follow the storefront's policies. Free tiers may include session limits or feature gates described in-app.
Chargebacks without contacting us first may result in account suspension.
7. Intellectual property & licence grant
All rights in BabyCam—software, UI, text, graphics, and trademarks—remain with Yunda and licensors. We grant you a personal, revocable, non-transferable licence to run the object-code app on devices you own.
You may not copy (except backup), rent, sublicense, or create derivative works.
8. Medical, safety & supervision disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BABYCAM DOES NOT DIAGNOSE, TREAT, OR PREVENT ANY MEDICAL CONDITION.
CRY OR MOTION ALERTS MAY FALSE-POSITIVE OR MISS EVENTS. ALWAYS VERIFY PHYSICALLY.
EMERGENCY NUMBERS & CLINICAL DECISIONS ARE YOUR RESPONSIBILITY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY UNITS OF YOUR LOCAL CURRENCY IF YOU NEVER PAID US.
WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES EVEN IF ADVISED OF THE POSSIBILITY.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS—THEN OUR LIABILITY IS LIMITED TO THE MINIMUM LEGALLY PERMITTED.
10. Indemnity
You will indemnify, defend, and hold harmless Yunda, its affiliates, directors, employees, and partners from any claim arising out of your misuse, violation of law, negligence, or infringement of third-party rights, except to the extent caused by our wilful misconduct.
11. Suspension, termination & survival
We may suspend or terminate access immediately for risk, abuse, non-payment (where applicable), or legal demands.
You may stop using BabyCam at any time by uninstalling. Sections that by nature should survive (limitations, indemnity, governing law) remain effective.
12. App stores & third-party services
Apple and Google are not parties to these Terms and are not responsible for addressing support claims. You may need to accept separate SDK or authentication terms (Sign in with Apple, Google OAuth).
13. Governing law, informal resolution & courts
Nothing in these Terms limits non-waivable consumer rights in your country of habitual residence.
Before filing suit you agree to email soporte@yunda.me with a description of the dispute and attempt good-faith negotiation for thirty days.
If mandatory arbitration applies in your jurisdiction, those rules supersede this paragraph only to the extent required.
14. Changes to these Terms
We may modify these Terms by posting an updated version and revising the “Last updated” date. Material changes may require in-app acceptance. Continued use after the effective date constitutes acceptance where allowed.

16. Independent contractors & non-exclusivity
Nothing creates a partnership, agency, or employment relationship. You may use competing products—subject to confidentiality obligations you owe third parties.
17. Force majeure
We are not liable for delays caused by events beyond reasonable control: internet outages, cloud provider failures, war, natural disasters, strikes, or regulatory bans.
18. Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale with notice when required.
19. Feedback & suggestions licence
If you send ideas, bug reports, or feature requests, you grant us a perpetual, royalty-free licence to use them without obligation of confidentiality or compensation, except where prohibited.
20. Export & sanctions compliance
You represent that you are not located in a comprehensively embargoed country nor listed on restricted-party lists. You will not export BabyCam in violation of EAR, OFAC, or local regulations.
21. Open-source & third-party notices
The app may include open-source components governed by their licences (for example WebRTC, Flutter plugins). Copies of notices are available inside the app settings or on request.
22. Entire agreement & severability
These Terms and the Privacy Policy constitute the entire agreement on their subjects. If a provision is invalid, the remainder stays enforceable.
